{"id":1035,"date":"2024-08-21T11:29:04","date_gmt":"2024-08-21T11:29:04","guid":{"rendered":"https:\/\/friscotimes.org\/?p=1035"},"modified":"2024-08-21T14:14:08","modified_gmt":"2024-08-21T14:14:08","slug":"u-k-might-follow-europe-in-fining-employers-who-mesage-staff-after-hours","status":"publish","type":"post","link":"https:\/\/friscotimes.org\/?p=1035","title":{"rendered":"U.K. might follow Europe in fining employers who mesage staff after-hours"},"content":{"rendered":"\n<p>The U.K. is considering joining a host of other European countries in making it more costly for restless employers to contact their employees after the working day ends.<\/p>\n<div>\n<p>The country\u2019s fresh-faced Labour government is drafting legislation that would outlaw late-night WhatsApps, emails, and Slacks and potentially fine dissenting bosses heftily.<\/p>\n<p>While commonplace across Europe, legislation giving workers a \u201cright to disconnect\u201d has lagged behind in the U.K., but now might become more European if reported changes to work culture are implemented.\u00a0\u00a0<\/p>\n<h2 class=\"wp-block-heading\">Special relationship<\/h2>\n<p>The U.K. has often been a special case in Europe, separated from most of the continent by a body of water and its exit from the EU in 2020.<\/p>\n<p>It has lent on its historic links with the U.S. to attempt to build business partnerships, but its work culture hasn\u2019t always tended to follow suit.<\/p>\n<p>U.K. employees typically enjoy more of a work-life balance than their counterparts across the Atlantic, enjoying more annual leave and <a href=\"https:\/\/worldpopulationreview.com\/country-rankings\/average-work-week-by-country\" target=\"_blank\" aria-label=\"Go to https:\/\/worldpopulationreview.com\/country-rankings\/average-work-week-by-country\" rel=\"noopener\" class=\"sc-93594058-0 fowfrQ\">working fewer hours<\/a>.<\/p>\n<p>They\u2019re also much less work-oriented than those in the U.S. and, indeed, anywhere else. Data analyzed by King\u2019s College London last year found just a quarter of employees said work was very important or rather important to them, a fraction of the share in the U.S. and France.<\/p>\n<p>The new U.K. Labour government is considering edging closer to its European peers to enshrine more rights in an employee\u2019s working day.<\/p>\n<p><em>The Times <\/em><a href=\"https:\/\/www.thetimes.com\/uk\/politics\/article\/staff-contacted-out-of-hours-may-get-thousands-more-in-compensation-hm5dxs73r\" target=\"_blank\" aria-label=\"Go to https:\/\/www.thetimes.com\/uk\/politics\/article\/staff-contacted-out-of-hours-may-get-thousands-more-in-compensation-hm5dxs73r\" rel=\"noopener\" class=\"sc-93594058-0 fowfrQ\">reported<\/a> that the government may force employers to introduce \u201cright to switch off\u201d policies, legally requiring them to agree to workplace boundaries with their employees.\u00a0<\/p>\n<p>This could dictate expectations for the working day and the level to which bosses can contact employees over email, WhatsApp, or workplace messaging services after hours.<\/p>\n<p>Employees could be in line for hefty compensation if their employers breach these guidelines or don\u2019t have any \u201cright to switch off\u201d policies in place.<\/p>\n<p>\u201cIt has to be specific to each workplace and therefore it has to be something that businesses and their workforce agree among themselves rather than a diktat \u2014 and we\u2019re conscious of the disproportionate impacts of these sort of policies on smaller businesses, that will factor in to how we draft it,\u201d a source from the U.K. government told <em>The Times<\/em>.<\/p>\n<h2 class=\"wp-block-heading\">The right to switch off<\/h2>\n<p>Looking across the rest of Europe, the U.K. is playing catch-up.<\/p>\n<p>In 2013, Germany <a href=\"https:\/\/www.telegraph.co.uk\/news\/worldnews\/europe\/germany\/10276815\/Out-of-hours-working-banned-by-German-labour-ministry.html\" target=\"_blank\" aria-label=\"Go to https:\/\/www.telegraph.co.uk\/news\/worldnews\/europe\/germany\/10276815\/Out-of-hours-working-banned-by-German-labour-ministry.html\" rel=\"noopener\" class=\"sc-93594058-0 fowfrQ\">banned employers<\/a> from emailing their workers out of hours, except in an emergency.<\/p>\n<p>France moved in 2017 to force companies with 50 or more employees to establish hours when they could and couldn\u2019t message their employees.\u00a0\u00a0<\/p>\n<p>More legislation swept across Europe after the COVID-19 pandemic after remote work blurred the lines between home and the office and gave employers more opportunities to call on their workers at irregular hours.<\/p>\n<p>Research has shown that out-of-hours contact can <a href=\"https:\/\/www.researchgate.net\/publication\/319542297_Voluntary_Work-related_Technology_Use_during_Non-work_Time_A_Narrative_Synthesis_of_Empirical_Research_and_Research_Agenda\" target=\"_blank\" aria-label=\"Go to https:\/\/www.researchgate.net\/publication\/319542297_Voluntary_Work-related_Technology_Use_during_Non-work_Time_A_Narrative_Synthesis_of_Empirical_Research_and_Research_Agenda\" rel=\"noopener\" class=\"sc-93594058-0 fowfrQ\">negatively affect<\/a> employees\u2019 well-being, ultimately harming their long-term productivity and creating an increasingly strained boss-worker dynamic.<\/p>\n<p>In 2021, the Portuguese government banned bosses with more than 10 employees from contacting their staffers after hours, with fines for dissenters reaching up to \u20ac10,000.<\/p>\n<p>The U.K. government is still examining how its \u201cright to switch off\u201d policies would work in practice, but changes to compensation could see fines similar to those in Portugal.<\/p>\n<p>In Ireland, where the U.K. is understood to be taking its lead, the government introduced \u201cRight to Disconnect\u201d guidelines that called on employers and employees to agree on reasonable expectations for out-of-hours contact.<\/p>\n<p>However, there\u2019s no guarantee that more rigid boundaries will be what all employees want.\u00a0<\/p>\n<p>Some employees hailed the flexibility that remote work afforded them, helping them work when they were most productive rather than the mandated 9-to-5.<\/p>\n<p>The bosses, though, grumbled that this created a \u201cDead Zone\u201d between the typical working hours of 4 pm and 6 pm.<\/p>\n<\/div>\n<div data-cy=\"subscriptionPlea\"><strong>Recommended Newsletter:<\/strong> CEO Daily provides key context for the news leaders need to know from across the world of business.
